Do you think I would have a good lawsuit?
When I was 13 I was diagnosed with scoliosis and had spine surgery to correct it. I had 2 curves and they were both really bad so it was a pretty major surgery. Then when I was 14 the bottom of my spine shattered under the pressure of my spine so I had to have another surgery. The doctor took out the bottom of my spine and replaced it with some special bones and replaced the bottom half of the hardware in my back. This was is 2009. In December of 2010 (11 months after my last surgery), I was reaching forward to set down a can of Sprite and I heard a loud snapping noise. After about a week I found out that one of the rods in my back and broke in half and pulled apart one of the fusions in my spine. The doctor said that the rod on the other side of my spine would be able to hold up until they did the surgery in late January to repair it. In the middle of January (approx. 2 weeks before my surgery was scheduled for) my dad took me to the hospital to have the pretests done for surgery. When we were leaving the hospital we both heard an unbelievably loud snap and I fell to the ground. I wasn't able to move from the waist down. The other rod had also broke and there was no connection going from my brain to my legs. My dad was able to get me to the ER and there was no guarantee that I would be able to walk again. I had to stay in the hospital for 5 days until I could have my surgery and then I was in for another 5 after that for recovery. I am now almost 17 and I have a ton of problems with my back. I am a junior in high school and I can only go to school for 2 hours a day because the pain is so bad. I have to take a bunch of medicine to try and keep the pain under control. I am running out of things to try and make my back better. I have done everything from physical therapy to acupuncture and nothing is helping. I get intense leg spasms and I can't walk for a long distance. These problems only happened after the rods in my back broke. Now my parents are looking for a lawyer because it looks like I will have these problems for the rest of my life. They want to make sure that I will be covered for life encase I cannot work. My parents are talking about suing the company that made my rods. We know that it isn't the doctors fault. He doesn't decide which rods go in his patients and which ones don't. I would love to put this company out of business because I don't want them to mess up someone else's life like they have mine. Do you think that we would have a good lawsuit if we did go after the company? We aren't the type of people to just go around and sue. We would never have dreamed of doing this if it wasn't for the problems I now have to live with because of their mistakes. These rods are made of titanium, they aren't suppose to break that easily. And I wasn't out playing sports or being stupid at all since I had my first surgery at 13. If I was out being extremely active I would probably understand that they were pushed to their limits. I was still in the healing process from my surgery at 14 so I knew I couldn't go out and act like a normal teenager. My family has to spend alot of money on my medicine and going back and forth from all of my doctors appointments, especially because most of the doctors are an hour away from my house. Please give me your opinion of what I should do or how I should handle this. I really appreciate it!
